DEMING* – A Deming man plead guilty to aggravated assault with a deadly weapon, a fourth-degree felony last week.
The Deming Headlight reported that Patricio Martinez, age 21, had been facing trial for second degree murder, but reached a plea agreement with prosecutors under which they would cap their sentencing recommendation at a suspended sentence.
The maximum prison sentence for the aggravated assault charge is 18 months with one year of parole and up to a $5,000 fine. The murder charge is dismissed.
Saturday, Sept. 19, 2020, Deming police responded to reports of shots fired on the north side of Deming.
Roland Valenzuela, age 36, was killed in a brief exchange of gunfire that followed an argument between Valenzuela and Martinez’s father outside a residence on West First Street.
Valenzuela died at Mimbres Memorial Hospital from multiple gunshot wounds.
Martinez was also wounded, as was a neighbor while evacuating his family from their nearby front porch.
