The verdict, delivered by District Court Judge Jennifer DeLaney, followed a Luna County jury's unanimous decision to find Ricoy guilty of first-degree murder and related charges on March 28, 2024.
The tragic events unfolded when Kern and his wife, Emili Jones, visited Ricoy and Kern's mother, Kelly Kern, to retrieve an ice chest. Ricoy, enraged by their presence, fired an AR-15 at their car, where their children and a friend were seated. Despite Kern's plea to leave, Ricoy fatally shot him.
During the emotional sentencing hearing, Kern family members, including Kern's nine-year-old stepson, addressed the court. Chief Deputy District Attorney Anne Swank urged the maximum penalty, emphasizing the gravity of the crime. Despite the defense's plea citing Ricoy's age of 59, Judge DeLaney sided with the prosecution, imposing the maximum sentence permissible by law.
In response, Sixth Judicial District Attorney Michael R. Renteria expressed satisfaction with the outcome. He commended his team for meeting the burden of proof and appreciated the court's thoughtful sentencing. Renteria acknowledged that while nothing can fully heal the family's wounds, he hopes the conviction and sentencing bring them some solace.
