DEMING - Cruz Garcia, 28, found himself in police custody after a startling incident unfolded in the 700 Block of Tin Street. Garcia was arrested by Deming Police Officers for unlawfully entering a residence, which, unbeknownst to him, belonged to an off-duty Deming Police Officer. The officer, along with his family, was present at the time of the intrusion.
Deming Interim Police Chief Jose Montoya, relayed to Deming Radio News that Garcia entered the officer's home unexpectedly, surprising the family who were in the midst of preparing dinner.
Garcia's request for a cigarette initiated an encounter with the off-duty officer, who promptly intervened and apprehended Garcia while his spouse promptly contacted emergency services.
Upon the arrival of officers, Garcia was charged with various offenses, including entering a house without consent, trespassing, disorderly conduct, and injuring or defacing property. Fortunately, no injuries were reported as a result of the incident.
