The Sunland Park City Council voted Wednesday evening to have Javier Perea
fill the spot. The Albuquerque Journal reports that the man who came in second in the spring mayoral election plans to seek a court order declaring him the winner.
Javier Perea says he will resign if Gerardo Hernandez obtains the court order. Hernandez lost the election to Daniel Salinas, who was unable to take the job because he faces extortion and other criminal charges.
Perea briefly held the office in April. He resigned when state officials said the meeting in which he was tapped as mayor appeared to violate the state Open Meetings Act.
