
A criminal complaint filed this week in Luna County Magistrate Court accuses Sgt. Bobby Brookhouser of intentionally making a false material statement of fact on an arrest warrant affidavit and criminal complaint, and also of making a false report to an official of the Sixth Judicial District Attorney’s office.
The charges stem from a report filed by Brookhouser on a 2017 criminal sexual penetration case in which Brookhouser wrote that the suspect admitted to his crime during an interview.
The videotaped interview was reviewed by Lead Investigator Hector Carrillo with the District Attorney’s office, who determined that the suspect never gave a verbal confession.
Brookhouser, who has worked for the Luna County Sheriff’s office for over 18 years, is currently on administrative leave.
Sheriff Kelly Gannaway confirmed that an internal investigation is underway as well.
