
Foy held a news conference Friday and maintained Estevez’s innocence.
Estevez was pulled over by Silver City police on Saturday, June 11th, after a witness called 911 to report Estevez’s state-owned vehicle swerving into on-coming traffic and the shoulder while driving eastbound on Highway 180 toward Silver City.
Silver City Police reportedly found Estevez driving a car with a flat tire on the front passenger-side of the vehicle. Foy claimed the flat tire caused her to swerve.
He also explained Estevez’s driving as a reaction to being spooked by the witness who he said was “tail-gating” Estevez.
Lapel camera video recordings captured officers’ skepticism about the situation, with a Silver City officer saying Estevez was “loaded.”
Lapel camera recordings also captured Estevez tripping toward the trunk of her car, changing her story about from where she was driving, falling into her car seat, and stumbling while she appears to practice a heel-toe walking test.
Silver City Police and a New Mexico State Police officer who responded to the scene declined to do a DWI investigation.
Foy said Estevez doesn’t drink, use drugs or have a problem with prescription medication.
Estevez did not speak at the news conference on Foy’s advice.
Foy said he was directing her not to answer questions until he was “absolutely certain” there would be no charges in the incident.
