(Deming) – Luna County’s attempt to permanently bar a local activist from attending commission meetings fell short Tuesday.

     Sixth Judicial District Court Judge Jennifer Delaney dismissed the county’s application for a permanent injunction to keep Larry Caldwell from attending county meetings or approaching county officials, saying the county had not met the threshold required to approve such an action.

     Delaney also told Caldwell that we live in a time of heightened sensitivity to threats – either real or perceived – and Caldwell needed to be aware of how comments can affect people.

     The county filed a temporary restraining order on Caldwell after the February 14thcommission meeting when Caldwell was found to have a utility knife in his possession.

     Courthouse security staffer Moses Pastran said Caldwell made a comment about “cutting somebody’s throat” with the knife, but Caldwell testified that he said he didn’t bring the knife to cut anyone’s throat and that Pastran misunderstood him.
